Lost 6 of My Guns??

Well, I hope I'm not jumping to conclusions, but it sure seems that I may be out 6 handguns.

I consigned 6 handguns at a gun shop in Florida last Spring. ( We usually go to Ft Myers
for the winter, and back here to MN in the summer ) They were mostly $300 Ruger
semi autos and a Beretta. I've bought a gun, ammo, etc. from this guy before.
He's an Irag vet and seemed to be a very decent guy.

We didn't go down last winter ( My dad passing away, new granddaughter, etc. )
I had kept in touch with him. He said business was picking up with tax refunds and economic stimulus checks, etc. But now he hasn't answered my emails or returned phone calls
for the past 3 weeks. A guy on another board from the area said he was under the impression that the place was closed.

I don't know if I should contact the BATFE or what. I have a signed form from when I consigned the guns, with serial #'s etc. I'm thinking he has sold the guns , but isn't sending me my money.
Well, anyway, please feel sorry for me when you get time. Any suggestions? I do have a guy down there that is supposed to be checking to see if in fact the store is closed. I'm bummed.

I would be bummed too. Hopfully your friend will come back with some good news.....
I'd make some calls. The sooner the better.

I would have had an answer sooner but I was busy feeling sorry for you. :lol:
Thunderjohn, take the advice, contact the ATF, let them sort it out.

Next time someone here wants to put guns on consignment...get all your money first.....the very fact he accepts guns on consignment usually means that he's trying to make a show in the showcases on others' money...red flag!!! That's a bad hit...I'll pray for you to get the money or the guns back....soon......

What is the estimated value? If he did go out of business then may have to be pursued legally. If he went into bankruptcy then you are a creditor in the settlement and need to file paperwork with the courts establishing a claim. The owner may also be deceased in which case his executor needs to be informed of the liability. There should be a business registration with the State of Florida listing the principals including home addresses. You may even be able to access on line. If you can get a home phone number then you can call him at home and find out whats going on.

The reason I asked approximate value was Small Claims Court has varying limits for filing a suit yourself. You can probably find the Florida limit on line and file a claim yourself if necessary. If the limit covers the cost then go for it if all else fails.
If the ATF even thinks that he's moved and still selling guns, they WILL find him..I had an FFL in 77...only ordered 2 guns for officers...none for me...and when I moved, I left no forwarding address..only my girlfriend knew where I was....I got a call one morning...there they were....told me to send in my license for 30 days because I didn't have a change of address on file....told them I didn't need it anymore and sent it and my book in...they can find him for you...I'd tell the oldest agent they have nearby the whole story.....

If I got my money first, it would have been a sale.
The latest is, a guy from the area down there called the store and apparently he is still open.

That was my point....I don't trust many people enough to put it on consignment....

Here's a little update on my gun consignment.

The gun shop is still open. After not hearing from the owner for a month, the guy that rents our house down there stopped in the shop. The owner told him that he had sold a few of my guns and would be sending me a check. :roll:

Still no check and no reply, so I called the sheriff's office and, as I figured, they said it was a civil matter. It's like if you let your neighbor borrow your car and they never return it.
Civil, not criminal. I was just hoping they'd make a phone call to him.

So I checked on conciliation court and also called the ATF. After a couple calls and emails with
the ATF, I got an email from one of their investigators. She said she would try and resolve the matter with the gun shop owner.

Today I got an email from her saying she had spoken with the gun shop owner and he mailed
a check for all 6 guns yesterday. So now I'll wait a few days and see.

Thanks for everyone that has been praying for me and encouraging me. I really

So all it took was a call from an ATF investigator, huh? What a jerk that guy must be. I bet he wet his panties when He got the call. :lol: :lol:

I'd pay any fee at your bank to have the check cleared/posted/marked up or whatever they call it by phone from his bank....rather than have it come back hot in two weeks or so....or have him stop payment on it.... calling his bank to see if it will cash is not the same...there's a way they can grab the money so that it doesn't go away before the paper check clears his bank.....the ATF only had to hint that there might be an exacting inspection of his books and he'd borrow the money from his Mama.....amazing he'd only sold a few and now you're getting a check for ALL of them....the weasel oughta be shut down.....
